All assumption, we have no confirmation of this. I am basically saying Tobi is supposed to have EMS, apparently, but all we have seen is that one Space/Time jutsu. Kakashi also has a Space/Time jutsu, but he does not have EMS, we also don't have much details about how he acquired MS either.
So based on logic, Tobi from what we have seen, could just be someone that had Sharingan implanted, like Kakashi, and developed an “MS” mode that has a Space/Time jutsu. But then that begs the question of where did he get all those Sharingan in his hideout? Thus I assume that he was the one who carried out the massacre with Itachi and not the real Madara.
